Power of Attorneys: Why We Need Them

There are several legal documents and paperwork items that need to be considered in a person’s lifetime. The power of attorney, or POA, is one of those documents. This is a document that allows other people to perform legal acts on the behalf of another person, based on who is designated. There are also many reasons that you may choose to get a POA, so it’s helpful to know what they can do.

The Documents for a Power of Attorney

A power of attorney document is legally binding when properly created. To understand what you’re dealing with, it helps to understand the basic terms. For example, a durable power of attorney is a document that gives someone legal decision-making power in the event that you become incapacitated due to some sort of medical emergency or accident.

A limited power of attorney is another type of document. This one grants authority to the agent, or the person acting on behalf of the undersigned individual, on limited circumstances based on certain circumstances or events. A special power of attorney, on the other hand, might only apply to one or two special situations or for a short period of time. Then, you also have the springing power of attorney, which becomes effective at a future date, such as if you should become incapacitated.

A Road Map of What your Loved Ones Want

Power of attorney documents can be useful in several situations. They spell out people’s wishes and desires for their life, their belongings, and the decisions surrounding them. Some people make a financial power of attorney to have someone deal with finances when they can no longer do so on their own. Others may sign a medical power of attorney, which designates medical care guidelines and names an agent to act on the person’s behalf in the event of a medical emergency or situation.

A POA is a document that allows you to choose who gets to deal with certain aspects of your life. If you are not traditionally married or have another reason to believe there may be some dispute about who can act on your behalf, a POA could be the perfect answer. You can draft these for all kinds of needs and circumstances, including for necessity as life goes on and you find yourself unable to make these decisions yourself.
